GENERAL RELEASE AND ARBITRATION AGREEMENT: Each travel participant is requested to read and sign this General Release and Arbitration Agreement: The undersigned have read the tour brochure for and in consideration of being permitted to participate in the Trip and having access to the related services of W&L, its faculty, agents, employees, and all other persons or entities associated with it, relative to the Trip, without reservation, and on behalf of myself, my heirs, and my estate, hereby acknowledge that I have read, understand, and hereby agree to be legally bound as follows: Waiver, Release, Indemnification, and Hold Harmless Agreement: I agree that my participation in the Trip is voluntary. I acknowledge that there are risks inherent in traveling abroad and I agree to assume and accept any and all risks and responsibility for my health, safety, and property while abroad. Without reservation, and on behalf of myself, my heirs, and my estate, I hereby release and agree to indemnify and hold harmless W&L, its officers, trustees, agents, employees, and assigns, from any and all losses, claims, demands, causes of action, liability, or costs of whatever nature arising out of, or in any way related to my participation in this Trip including, but in no way limited to, injury, illness, death, loss or damage to property, delay, medical or other expense from any cause whatsoever (including, but not limited to, sickness, accident, weather, war, quarantine, government restrictions, act or omission of a landlord, common carrier, hotel, restaurant or other agency). 1. Mediation and Arbitration Agreement: If a dispute arises out of or relates in any way to this Agreement, breach thereof, or the Trip, and if the dispute cannot be settled through negotiation, I agree first to try in good faith to settle the dispute by mediation administered by the American Arbitration Association under its mediation procedures before resorting to arbitration. If the dispute has not been resolved after mediation, I agree that any controversy, claim, or dispute arising out of relating to this agreement, breach thereof, or the Trip, including but not limited to the issue of arbitrability, shall be resolved by arbitration administered by the American Arbitration Association in accordance with its rules in effect when the claim is filed, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitration shall be heard and decided by a panel of three arbitrators. Each party will pay its own Attorney’s Fees and costs. 2. I understand that if any provision herein is found to be invalid or unenforceable, the other provisions will remain in full force and effect. 3. I have read, understood, and accept the terms and conditions stated herein and acknowledge that I understand the legal consequences of signing this document, including (a) waiving my right to sue, and (b) and assuming all risks of participating in the Trip, including but not limited to travel to and from the activities or any events incidental to the activities.
